EPIC Restart Foundation Terms and Conditions

What these Terms cover 

We are here to support you, to restore your confidence, and self-belief and empower you to take the next steps in your journey of recovery. 

These are the Terms and Conditions (“Terms”) govern your use of our services, any products that are made available to you, and where we provide to you with support you and to help you take steps towards your recovery from a gambling addiction. 

These Terms shall apply to your use of the services accessible through the EPIC Restart Foundation, this includes all services accessed via our website https://www.epicrestartfoundation.org/ (“Website”) or any other sites used to deliver

EPIC Restart programmes or Services including the EPIC Restart Foundation Community; and any events, and coaching services that you may attend online or in person for the provision of support, mentoring, coaching and advice via any means including where you engage with us on our programmes (our “Services”). 

By using our Services, you confirm that you accept these Terms and that you agree to comply with them.

If you do not agree to these Terms, you must not use our Services.

Why you should read them: Please read these Terms carefully before you use our Services. These Terms tell you who we are, how we will provide Services to you, how you and we may change or end our relationship with you, what to do if there is a problem and other important information.

Please read these Terms carefully and make sure that you understand them. If you wish to access our Services or engage with us via our Engagement Platforms, you will be asked to agree to these Terms. If you do not accept these Terms, you will not be allowed to access the Services or engage with us via our Engagement Platforms.

These Terms together with the Privacy Policy contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the terms and conditions.

Who we are: We are EPIC Restart Foundation (“EPIC”),  a UK registered charity (number 1192907) (“we”, “us”, “our”).

Modifications to the Terms and Conditions: 

We may make changes to the Terms from time to time. A link to the most current Terms will be available on our Website and should be checked regularly to ensure familiarity with the then-current version.

Access to Our Services: 

The Services, including the Engagement Platforms, that are accessible to you are intended to be accessed by service users who are domiciled in the UK.

In order to access the Services, including the Engagement Platforms, you represent and warrant that you are at least 18 years old and that you have the capacity to enter into a binding agreement which creates legal obligations.

If you are under the age of 18, please do not attempt to register with us or on our Engagement Platforms or provide any personal information about yourself to us. If we collect personal information from someone who is under the age of 18, we will promptly delete that information.

Our Services are not available to service users who are located outside of the UK.

Accessing our Services, including Engagement Platforms, from jurisdictions where our content is illegal, or where we do not offer the Services, is prohibited.

Availability of Services: 

You acknowledge that the Services provided, the Engagement Platforms and the Website have not been developed to meet an individual’s requirements, and that it is therefore  it is your responsibility to ensure that the facilities and functions of the Engagement

Platforms and the Website meet your requirements.

We may transfer the Services, so that a different organisation is responsible for supplying your Services. We'll contact you to let you know if we plan to do this.

We do not warrant that the operation of our Engagement Platforms and / or Website  will be uninterrupted or error free, that defects will be corrected, or that the engagement platforms or the server that makes it available are free of viruses or represent the full functionality, accuracy, and reliability of the Engagement Platforms or Website. In no event will we be liable for any loss or damage including, without limitation, loss of profits, indirect or consequential loss or damage, or any loss or damages whatsoever arising from use, or loss of use of, data, arising out of, or in connection with, the use of the engagement platforms.

User Information: 

If you submit, upload, post, or transmit any health information, medical history, conditions, problems, symptoms, personal information, consent forms, agreements, requests, comments, ideas, suggestions, information, files, videos, images, or other materials to us or via our Engagement Platforms (the “User Information”), you agree not to provide any User Information that:

  • is false, misleading, inaccurate, defamatory, abusive, libellous, unlawful, obscene, threatening, harassing, fraudulent, pornographic, harmful, or that could encourage criminal or unethical behaviour;
  • violates or infringes the privacy, copyright, trademark, trade dress, trade secrets, or intellectual property rights of any person or entity; or
  • contains or transmits a virus or any other harmful component.

You agree not to contact other users of our Engagement Platforms through unsolicited e-mail, telephone calls, mailings, or any other method of communication.

You agree that information provided by you in connection with the Services and our Engagement Platforms shall be governed by our Privacy Policy.

If you engage in any Services or any programmes received or learned about through our Engagement Platforms or Website it is at your own risk and are voluntarily participating in these activities. We are not responsible for any health problems that may result from any content, services, programmes or events you learn about through our Services, the Engagement Platforms or the Website.

Content found on the Engagement Platforms or through the Website is for informational purposes only and is not intended to replace the relationship between you and your doctors or other medical providers. We are not a licensed medical care provider and have no expertise in diagnosing, examining or treating medical conditions of any kind, or in determining the effect of any specific exercise on a medical condition.

Any advice or other materials provided on the Engagement Platforms, Website or within any of our programmes are intended for general information purposes only. Any output does not constitute medical advice, a diagnosis or a treatment plan. They are not intended to be relied upon and are not a substitute for professional medical advice based on your individual condition and circumstances.

We are not responsible for the contents or reliability of any site to which it is linked and does not necessarily endorse the views expressed within them. Linking to or from our Engagement Platforms or Website should not be taken as an endorsement of any kind. We cannot guarantee that links will work all of the time and we have no control over the availability of the linked pages.

Access to our Engagement Platforms and the Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services.

We reserve the right to remove content from our Engagement Platforms or the Website where we reasonably suspect such content uploaded by you amounts to, but not limited to, material, which is obscene, indecent, pornographic, seditious, offensive, defamatory, threatening, liable to incite racial hatred or acts of terrorism, menacing, blasphemous or in breach of any third-party Intellectual Property Rights (“Inappropriate Content”).

Your obligations: 

In order to provide you with Services and access to the Engagement Platforms we do require certain information from you. When you provide information to us you should ensure that such information is complete and accurate. 

When you register to receive our Services and / or to be a member of our Engagement Platforms you may be asked to select, or provided with, a user identification code and password you can then use to access your account and log on to and/or participate in secure areas of the Website or Engagement Platforms.

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. 

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms. 

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at via the ‘Contact us’ information.     

You accept it is your sole responsibility to maintain the confidentiality of your password and you are responsible for all activity that occurs under this. You should make sure you are the only person using your password and you agree to notify us of any unauthorised use of your password and any other breach of security as soon as you become aware of it.

When you attend at any premises connected with the provision of Services you shall comply with all health and safety requirements set out by us, by law and as are otherwise applicable. 

When you participate in any EPIC Restart programme event or session you agree to abide by all reasonable requests made by our team aimed at maintaining a supportive and safe environment for all including but not limited to adhering to our NO ALCOHOL and NO ILLEGAL DRUGS policy.

You agree that you shall not: 
(a) create any content containing Inappropriate Content; 
(b) upload any Inappropriate Content to our Engagement Platforms or the Website; 
(c) use the Engagement Platforms or the Website for any purpose other than as intended by us; 
(d) use the Engagement Platforms or Website for any malicious or illegal activity or to distribute or share Inappropriate Content
(e) use threatening, abusive, violent or partake in any criminal behaviour, and shall be prohibited from participating in any type of harassing, discriminatory or abusive verbal or physical behaviour to any person during programmes, online sessions or meetings.

Failure to comply with these Terms could lead to EPIC Restart withdrawing its support from you and removal from our programmes and Services. 
Intellectual property

We retain all right, title, and interest in and to our Engagement Platforms, the Services and any information, documentation, software, or other materials on our Engagement Platforms, and any patent, copyright, trade secret, trade mark, service mark, or other intellectual property, or proprietary right in any of the foregoing, except for information on our Engagement Platforms, which is licensed to us (in that case, the licence provider retains all right, title, and interest therein).

The information that is available via our Engagement Platforms and via the Services is our property. You agree not to store, copy, modify, reproduce, retransmit, distribute, disseminate, rent, lease, loan, sell, publish, broadcast, display, or circulate such information to anyone.

Use, reproduction, copying, or redistribution of our trademarks, service marks, and/or logos are strictly prohibited without our prior written permission. The immediately foregoing sentence also applies to any third-party trademarks, service marks, and logos that are posted on our Engagement Platforms.

Nothing contained on our Engagement Platforms or Website should be construed as granting, by implication, estoppel, waiver, or otherwise, any licence or right to use any trademark, service mark, or logo that is displayed on our Engagement Platforms and / or Website without the written grant thereof by us, or the third-party owner of such trademark, service mark, or logo. Our Engagement Platforms may contain other proprietary notices and copyright information, the terms of which you agree to follow.

We may delete any information that you provide to us, which we consider in our sole discretion to be fraudulent, abusive, defamatory, obscene or in violation of any copyright, trademark or other intellectual property or ownership right of any other person or entity.

Our rights to make changes 

We may make minor changes to the Services, including the Engagement Platforms:

  • to reflect changes in relevant best practice laws and regulatory requirements; and
  • to implement minor technical adjustments and improvements. These changes will not affect your use of the Services.

More significant changes to the Services and these Terms. We may make changes to these Terms or the Services, but if we do so we will notify you. 

Data Protection

 We will treat all your personal data as confidential (although we reserve the right to disclose this information in the ways set out within these Terms and our Privacy Policy). We will comply with all applicable data privacy legislation.

Your privacy and the security of your information and personal data is important to us.

Any personal data that you provide to us will be collected and processed in line with our Privacy Policy. Our Privacy Policy explains what personal data we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal data and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal data.

Liability

We shall have no liability to you for any breach of these Terms caused by any event or circumstances beyond our reasonable control including, but not limited to, strikes, lock-outs or other industrial disputes; breakdown of systems or network access; or flood, fire, explosion or accident.

In no event will EPIC be liable for any loss or damage including, without limitation, loss of profits, indirect or consequential loss or damage, or any loss or damages whatsoever arising from use, or loss of use of the Services, arising out of, or in connection with, the use of the Services offered.

We will not be liable for any loss or damage (in contract, negligence or otherwise) where you have incurred any loss or damage resulting from a breach by you of these Terms. Nothing in these terms and conditions excludes or limits our liability for fraud or for death or personal injury caused by our negligence.

No Third-Party Rights: 

Unless expressly stated in the Terms to the contrary, nothing herein is intended to confer any rights or remedies on any persons other than you, us and our affiliates. Nothing in the Terms is intended to relieve or discharge the obligation or liability of any third persons to you or us.

Assignment: 

You may not assign, transfer, or delegate the Terms or any part thereof without our prior written consent. We may freely transfer, assign, or delegate all or any part of the Terms, and any rights or duties hereunder. The Terms will be binding upon and inure to the benefit of the heirs, successors, and permitted assignees of the parties.

Governing Law:  

These Terms shall be interpreted and construed under the laws of England.

Dispute Resolution:

The courts of England will have exclusive jurisdiction concerning all disputes or claims arising out of or relating in any way to these Terms or your use of our Engagement Platforms, including without limitation the Services, between you and us.

We will try to work in good faith to resolve any issue you have with our Platform, including without limitation the Products and Services ordered or purchased via our Platform, if you Contact Us.

However, we realise that there may be rare cases where we may not be able to resolve an issue to your satisfaction. We and you will try to reach an agreement to resolve the claim within 30 (thirty) days after the notice is received.

Force Majeure:

We will not be deemed to be in breach of these Terms or liable for any breach of these Terms or our Privacy Policy due to any event or occurrence beyond our reasonable control, including without limitation, acts of God, terrorism, war, invasion, failures of any public networks, electrical shortages, earthquakes or floods, civil disorder, strikes, fire, or other disaster.

Termination: 

We reserve the right to refuse to provide to you access to our Services and / or all or part of our Engagement Platforms or to terminate your access to our Services and / or all or part of our Engagement Platforms if your behaviour gives us a valid reason to do so. This will in particular be the case if you violate applicable laws, these Terms or contractual provisions.

Indemnification: 

You agree to defend, indemnify, and hold harmless us and any of our affiliates from and against any and all rights, demands, losses, liabilities, damages, claims, causes of action, actions, and suits (no matter whether at law or equity), fees, costs, and attorney’s fees of any kind whatsoever arising directly or indirectly out of or in connection with: 

  • your use or misuse of our Engagement Platforms, Services or any information posted on the Website;
  • your breach of these Terms or Privacy Policy;
  • the content or subject matter of any information you provide to us; or
  • any negligent or wrongful act or omission by you in your use or misuse of our Services or Engagement Platforms or any information on our Engagement Platforms, including without limitation, infringement of third-party intellectual property rights, privacy rights, or negligent or wrongful conduct.

General:

In the event that any of the Terms are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

These Terms constitute the entire agreement between us regarding the subject matter hereof.

Certain provisions of these Terms may be superseded by expressly designated legal notices or terms located on particular pages within our Engagement Platforms.
